These Terms of Service are a binding agreement between you and MindNdata, the operating entity that builds and runs Pockit. By creating an account or using Pockit, you agree to these Terms and to the Pockit Privacy Policy.
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and MindNdata, the operating entity that builds and runs Pockit. By creating an account or using Pockit, you agree to these Terms and to the Pockit Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use Pockit.
MindNdata is the operator of Pockit. MindNdata is not an incorporated company; it is the operating entity responsible for the service.
2. Who we are and what Pockit is
Pockit is a capture-and-recall app: the fastest way to save a digital thing from your phone, and the most reliable way to find it again. It holds links, social posts, screenshots, images, documents, and written notes; it organises them into categories automatically; and it answers plain-language search over everything you have saved. Saving works through the Android system share sheet and an in-app Add flow. Pockit does not accept video-file uploads; a saved social post is kept as its link, thumbnail, and text.
3. Age, and who can use Pockit
Pockit does not collect or verify your age. There is no age check at sign-up, so Pockit cannot determine how old you are. Pockit is made for adults, and adults may use it normally. If you are under 18 and you use Pockit, you do so on the basis that a parent or legal guardian knows about your use, approves of it, and gives you the supervision and guidance appropriate to your age; you and your guardian accept these Terms and take responsibility for your use on that basis. If you are a parent or legal guardian, you are responsible for the use and the account of a child in your care, and you can delete that account and its data at any time (see Section 11).
4. The service today: free and uncapped
Today, Pockit is free to use and uncapped, there are no limits on how much you can save and no paid gates on its core promise. We provide the service on this basis today. Section 12 sets out our reservation to change the commercial model in the future, with reasonable notice; that reservation does not change the free-and-uncapped position today.
5. Your account
You sign in to Pockit using your Google account (Google Sign-In). You are responsible for keeping access to your account secure and for activity that happens under your account. Tell us at support@pockit.in if you believe your account has been compromised. You must give accurate information and not impersonate anyone else.
6. Your content and the licence you give us
You own your content. The links, posts, screenshots, images, documents, notes, and other material you save to Pockit ("Your Content") remain yours. These Terms do not transfer ownership of Your Content to MindNdata.
The limited licence you grant. To operate Pockit for you, you grant MindNdata a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, process, analyse, describe, categorise, index, and display Your Content solely to provide, maintain, secure, and improve the Pockit service for you, for example, to store your saves, generate titles and descriptions, file them into categories, build the search index, and show them back to you. This licence exists only to run the service; it does not permit us to sell Your Content or use it for unrelated purposes. It lasts while Your Content is in Pockit and ends when you delete Your Content or your account, except for content that must be retained for the limited legal reasons described in the Privacy Policy, and except for copies that take a reasonable time to purge from backups.
You are responsible for what you save. You represent that you have the right to save and use Your Content in Pockit, and that doing so does not break the law or infringe anyone's rights.
7. Acceptable use
When using Pockit, you agree not to:
save, store, or distribute content that is illegal, or that infringes intellectual-property, privacy, or other rights of others;
use Pockit to store or process child sexual abuse material, content that is unlawful, harassing, threatening, hateful, or that incites violence;
attempt to break, overload, probe, or circumvent the security, rate limits, or access controls of Pockit or its providers, or access another user's data;
reverse-engineer, scrape, or misuse the service or its APIs beyond what these Terms and applicable law allow;
use Pockit to build a competing dataset or service from other users' data; or
use automated means to abuse the service or to save content at a scale intended to harm the service or its providers.
We may remove content or suspend or terminate accounts that violate this section (see Section 11).
8. Third-party processors and services
Pockit relies on third-party service providers to work, including Google (Gemini AI and Google Sign-In), Scrape Creators, Apify, Supabase, Resend, PostHog, and Sentry. These providers act as our processors, under our instructions, as described in the Privacy Policy. Their availability and behaviour are partly outside our control; where a provider changes, degrades, or interrupts its service, some Pockit features may be affected. Your use of Pockit is also subject to the acceptable-use rules of the underlying platforms whose content you save.
9. Service availability and "as is" disclaimer
We work to keep Pockit fast, reliable, and correct, but we provide it "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. In particular, we do not warrant that Pockit will be uninterrupted, error-free, or perfectly accurate, that AI-generated titles, descriptions, categories, or search results will always be correct or complete, or that it will meet every requirement you have. AI features are automated and can make mistakes; use judgment before relying on them. Pockit is a place to keep and find your saves, it is not a backup, archival, or records-retention service, and you should keep your own copies of anything you cannot afford to lose.
10. Limitation of liability and indemnity
Limitation of liability. To the fullest extent permitted by law, MindNdata and the people who operate it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, goodwill, or savings, arising out of or relating to your use of (or inability to use) Pockit, even if we have been advised of the possibility. Because Pockit is provided free of charge today, to the fullest extent permitted by law our total aggregate liability to you for all claims relating to the service is limited to the greater of (a) the amount you have paid us to use Pockit in the twelve months before the claim (which is zero while the service is free) or (b) ₹1,000. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.
Indemnity. You agree to indemnify and hold harmless MindNdata and the people who operate it from claims, damages, losses, and reasonable costs (including legal fees) arising from Your Content, your use of Pockit, or your breach of these Terms or of the law.
11. Termination and account deletion
You can leave at any time. You can stop using Pockit and delete your account and its associated data at any time, in the app (Profile, delete account) or on the web at https://pockit.in/delete-account, without reinstalling the app. Deletion is described in the Privacy Policy.
We may suspend or terminate your access if you materially breach these Terms (for example, the acceptable-use rules in Section 7), if required by law, or if necessary to protect the service, other users, or our providers. Where reasonable and lawful, we will give notice. On termination, your right to use Pockit ends; sections that by their nature should survive (ownership, licence wind-down, disclaimers, limitation of liability, indemnity, governing law) survive.
12. Our reservation on the future of Pockit
Today, Pockit is free and uncapped, and nothing in this section changes that today. MindNdata expressly reserves the right, in the future and with reasonable notice, to:
introduce any future revenue model for Pockit, including advertising, a subscription or SaaS-style pricing model, or any other monetisation approach;
scale, change, restructure, or incorporate the underlying operating entity behind Pockit (for example, moving from the current unincorporated operating entity to an incorporated company), and to assign or transfer these Terms, the Privacy Policy, the service, and associated data to that successor or acquiring entity as part of such a change; and
update these Terms and the Privacy Policy over time to reflect the above.
We will provide reasonable notice of material changes as described in Section 13, and where a change requires your consent under applicable law, we will seek it.
13. Changes to these terms
We may update these Terms as Pockit evolves. When we make a material change, we will update the effective date above, post the current version at https://pockit.in/terms, and give reasonable notice by appropriate means (such as in-app notice or email) before the change takes effect where required. If you continue to use Pockit after a change takes effect, you accept the updated Terms. If you do not agree to a change, stop using Pockit and delete your account.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules, and the courts in India have jurisdiction over any dispute arising out of or relating to these Terms or Pockit, subject to any mandatory rights you have under applicable law. For any data-related grievance, please first use the grievance mechanism in the Privacy Policy (which must be exhausted before approaching the Data Protection Board of India).
